Common Scenario at Amazon
Here is a typical step by step of issues those with disabilities face at Amazon
Step 2: Amazon does not engage in an interactive process
Most commonly. Amazon is not responsive for up to 7 months. There is no back and forth and they generally will deny WFH or other major accommodation needs.
Step 3: Amazon tries to get you to accept subpar Accomodations
This is the stage after they deny your initial request. Typically they will offer the lowest cost solution like headphones. This is the point in the process where you need to not accept subpar accommodations. You need to advocate for yourself and speak up. Stating why you need your accommodation, disagree with their subpar accommodation in writing and state that you will provide a doctor note or a second doctor opinion sharing why you need the accommodations you need.
Step 1: You request an Accommodation
Typically an employee will request an accomodation from HR or MyHR tool. You will then need to submit medical documentation. It's important to meet with one or more doctors and have them fill out the amazon forms.
Step 4: If they do not accept your accommodation, this is the stage to find a lawyer and have your lawyer talk on your behalf with Amazon
Many Amazonians get denied their accommodation. Our surveys indicated that 70% had 50% or more accommodations denied. When accommodations are denied and Amazon does not follow an interactive process, more harm continues to occur to the employee. Many times Amazon is not following the ADA and giving employees an ultimatum to accept the subpar accommodations or be fired. This is horrible and unacceptable. A lawyer can help negotiate with Amazons lawyers and ensure that you are legally protected.
Step 5: Document everything, all emails, communications and keep evidence and file with the EEOC
As your lawyer will tell you, you need to collect all evidence. You should be doing this from the start of your employment until the very end. The more documentation and evidence you provide a lawyer, the more likely they can help you. In addition to finding a lawyer, you want to file with the EEOC and state you are similarly situated to other Amazon employees who faced disability discrimination.
Step 6: File with the NLRB
The NLRB is a separate organizing from the EEOC and it's a government group that creates policies and enforces laws for companies like amazon. Filing in the even you were preventing from speaking, or stopped from Organizing is another tool at your disposal to hold Amazon Accountable
Step 7: Connect with fellow Amazonians on PWD-Disability, Remote-Advocacy, Disability-Accessibility-Issues-Amazon slack groups and outside of work
There are many organizing leaders at Amazon who post on these slack groups. The key is to ask for their contact info, look for their posts and reach out to them via email, our website and they and us will put you in contact with resources. You can also share your story and we will post it here and we can connect you with the media to tell your story.
